These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Patient") and Peak Asset Performance LLC, doing business as TrimDoctor ("TrimDoctor," "we," "us," or "our"), governing your access to and use of the TrimDoctor website, patient portal, mobile applications, and all related services (collectively, the "Platform").
By creating an account, completing an assessment, purchasing a subscription, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our HIPAA Notice of Privacy Practices.
IMPORTANT: TrimDoctor provides a technology platform that facilitates access to telehealth services. TrimDoctor is NOT licensed to practice medicine and does NOT provide medical care. All medical evaluations, diagnoses, prescriptions, and treatment decisions are made solely by independently licensed healthcare providers.
TrimDoctor's role is strictly limited to:
Medical decisions, including whether to prescribe medication, are made by independent physicians contracted through our partner physician network. The physician-patient relationship exists between you and the treating provider, not between you and TrimDoctor.
To use the Platform and our services, you must:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. TrimDoctor is not liable for any loss or damage arising from your failure to maintain the security of your account.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. We reserve the right to suspend or terminate accounts that contain false or misleading information.
TrimDoctor offers the following subscription plans. All prices are in U.S. dollars and exclude applicable taxes:
All medication subscription plans include physician consultation, medical evaluation, and ongoing care coordination at no additional charge.
Subscriptions are billed on a recurring monthly basis through Stripe, our payment processor. Your first month may be charged at a promotional rate; subsequent months are billed at the standard plan rate.
In the event of a failed payment, Stripe will automatically retry the charge up to 3 times over a 10-day period. If all retries fail, your subscription will be paused until you update your payment method. You may update your payment information at any time through the patient portal.

IMPORTANT DISCLOSURE: Medications dispensed through TrimDoctor are compounded by FDA-regulated compounding pharmacies operating under Section 503A and/or Section 503B of the Federal Food, Drug, and Cosmetic Act. Compounded medications are NOT FDA-approved as finished products and have not undergone the same testing and approval process as commercially manufactured FDA-approved drugs.
The decision to prescribe a compounded medication is made by your independently licensed healthcare provider based on their medical judgment and your individual health profile.
Healthcare services are delivered via telehealth, which may include asynchronous (store-and-forward) and/or synchronous (video or audio) consultations, at the provider's discretion. By using the Platform, you consent to receiving healthcare services via telehealth and acknowledge the inherent limitations of remote care, including the inability to perform a physical examination. You agree not to use the Platform to:
All content on the Platform — including text, graphics, logos, images, software, and the overall design and layout — is the property of Peak Asset Performance LLC or its licensors and is protected by applicable intellectual property laws. "TrimDoctor" and "TrimDr+" are trademarks of Peak Asset Performance LLC. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIMDOCTOR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES.
IN NO EVENT SHALL TRIMDOCTOR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO TRIMDOCTOR IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Peak Asset Performance LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.
CLASS ACTION WAIVER: YOU AND TRIMDOCTOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Arbitration shall take place in Delaware. You may opt out of this arbitration provision by sending written notice to help@trimdoctor.com within 30 days of accepting these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for material changes via email and/or a notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
